    Spectator hit by golf ball

    Over recent weeks, we have seen many comments regarding the injury to the spectator Corine Remande, who was hit by a golf ball at Ryder Cup. Sadly as a result of accident, she has lost sight in one eye.
    Reports indicate she will be taking a civil case out against the organisers. We are not sure what the civil laws are in France but probably would be based around if they have breached their civil law duty of care.
    What controls measures would you have expected to see in place to prevent this type of accident occurring? Would you expect to see safety info on the tickets, which would forewarn spectators of the chance of stray golf balls. Would it be right assume the spectators in the main are golf fans, and therefore knowledgeable of the sport and understand the risks. Would the likelihood of golfers shouting ‘fore’ which is traditional would not be heard, from the TV footage, this shout can be heard but it is not clear from who.
    Marshall’s on the course could only indicate the direction of travel for the golf ball, with spectators expected to keep an eye on play. Should signs be present on all golf holes about the chance of stray balls, at key positions?
    With all these risk control measures in place, could it be said the organisers were in breach of the duty of care? This question is what the civil case will hinge on. Clearly a duty is owed and clearly she has suffered loss. Would this case set a precedent? I doubt it! But may make event organisers even more wary of civil liabilities!
